Mojjo Services are ensured by PLAYR SAS. The provision of these Services involves the collection of personal data. The section below, attached to the ToU (https://www.mojjo.io/cgu), describes in detail how this data is managed. PlayR attaches the utmost importance to protecting the privacy of its Users and people filmed on the courts. Users and people filmed are invited to report any malfunction and especially any breach of their rights via the address contact@mojjo.io. By using the mojjo Services, you acknowledge to read and accept unreservedly the ToU including this section attached thereto.
ARTICLE 1: CNIL DECLARATION
In application of the french law n ° 78-17 of January 6th, 1978 "Informatique et Libertés", it is reminded that the personal data which is collected has been duly declared to the french CNIL institution: declarations 1851815 v 0 & 1851816 v 0.
ARTICLE 2 : COLLECTED DATA
When using the web Site, the mobile Applications or the Kiosk, the User providew information concerning him/her including:
- Email-address ;
- The name and surname of the User;
- The date of birth of the User;
- The ranking of the User;
- The statistics of the User;
- The videos of the User;
- The profile picture of the user
- The correspondence between the Users exchanged on the Site or on the Applications.
When capturing video sessions and live streaming, PlayR may also collect videos from people within the club near the mojjo court.
When User proceeds to payments, PlayR collects transaction history as required by the law but does not process the most sensitive data (such as credit card numbers). The most sensitive data is only processed by our payment provider "Stripe" (https://stripe.com/privacy); with all the required guarantees.
When using the Services, PlayR collects other non-user-related data, such as the type of terminal (computer, tablet or mobile), the IP address, the type of browser, the system of operation or location. This information is used for statistical and service improvement purposes.
The collected data is accessible by certain PlayR employees and subcontractors, all of them are strictly authorized for this purpose.
In particular case of live streamings broadcasted using Facebook, the User grants PlayR through the kiosk to access to his facebook account in order to broadcast the video. PlayR do not use any data of the User facebook account except the data strictly needed to ensure the live streamining. Once the live streaming is over, PlayR do not keep any facebook data used for the live streaming.
ARTICLE 3: CONSENT, PROPERTY AND DATA SHARING
The videos and statistics obtained on the court are captured on the initiative of the people present on the court, from the interactive Kiosks available on the courts. These videos and data are captured with the mutual consent of all those present near the concerned tennis court during the capture. It is the responsibility of the person who originally triggers the capture from the Kiosk to ensure the consent of the filmed people and to ensure their agreement; especially during live public streaming on the internet. PlayR declines any responsibility in the event that data and/or videos have been captured without the consent of the involved persons.
The photos, texts, images, logos, names or trademarks mentioned in the videos are the property of their respective owners. The players / people who trigger originaly the video/data capture from the Kiosk recognize and agree to be solely responsible for these videos and the consequences of their dissemination. PlayR does not endorse any content, opinion, recommendation or opinion expressed in the videos, and PlayR expressly disclaims any liability for these videos.
The players / people filmed retain their intellectual property rights on their data, but are required to grant limited rights:
- to PlayR who edits video, creates compilations and automatic summaries of matches,
- to other users of the service with whom they share this content, starting with their opponents during these sessions,
- to the people who originaly triggered the capture from the Kiosk on the court, including cases of live streaming broadcast.
Users consent to their name, rank, profile picture, videos and statististics being shared with the people they create relationship with within mojjo Services : friend or coach.
Users also consent to their name, rank, profile picture and match sheet (including video) being shared with their opponent, as well as their opponent's relationships (friends or coaches).
By participating to automated tournament, Users consent to their name, rank, profile picture and tournament matchs sheets (including video) being publicly shared. Their club may also share tournament contents outside mojjo Services.
In the event of an incident filmed (violence, insult, degradation, etc ...) during a mojjo session, the club will have a right of access to the concerned video.
Users also agree that their data, once anonymized, may be used without limitation by PlayR, for the main purpose of improving the operation of the PlayR algorithms and excluding in particular being sold to any third party.
ARTICLE 4 : COOKIES
Cookies are used to facilitate the navigation on the Site. They store some navigation information during the visit and facilitate navigation on the Site and related User support. These cookies are not used in any case for advertising purposes. A "cookie" is a small computer file that the internet browser downloads to your computer. In other words, it is a piece of data stored on your computer. A cookie file allows to identify the computer during the period of validity of the cookie.
ARTICLE 5 : RIGHT OF ACCESS, RIGHT OF CHANGE
The User has the right to access, modify or delete the data concerning him/her either directly by modifying his/her profile or by contacting mojjo at the following address: contact@mojjo.io
The information thus collected is intended to be used exclusively by mojjo and its service providers. Any dissemination to third parties of personal data collected on Users will be the subject of an express and prior request.
PlayR SAS has an IT team to manage the User support of the Site and Applications and to control related content. The data recorded by Users are available to the PlayR team located in France and to its service providers located in France and Europe.
Accepting the processing of the data as mentioned on this section and in ToU section is a mandatory condition for the use of the mojjo Services.
User and video data are hosted on Amazon Web Services Ireland.
